Contract/Purchase Agreement

For the Vizsla Puppy as described here:

 This puppy has been sold to  ____________________________________ with Limited AKC papers.

 ·       The Seller guarantees this dog to be in good health on the date of sale. The dew claws have been removed and the tail docked.

·       Purchaser agrees to have the puppy examined by a licensed veterinarian within the first seven days after the date of physical transfer of the pup.  Should the veterinarian determine the puppy to be in ill health, Purchaser must notify the Seller immediately.  Should the veterinarian determine this dog to be in ill health, the cause of which is clearly attributable to the Seller, this dog may, upon presentation of a written diagnosis from said veterinarian, be returned for a refund of purchase price or replacement puppy. Upon receipt of the puppy, the Seller shall be obligated to replace the puppy with one of equal quality from the current litter or future litter of the above-mentioned sire and dam instead of the refund of the purchase price and further performance under this contract shall be null and void. If the buyer chooses to have a replacement puppy, the buyer may elect to accept a puppy from a current or future litter with other parents if the wait time will diminish greatly.  Any veterinarian’s diagnosis shall be subject to confirmation by a veterinarian chosen and paid for by Seller.  Should said veterinarian not concur with the diagnosis of Buyer’s veterinarian, the matter shall be presented to a third veterinarian (cost shared between Buyer and Seller) for final diagnosis. Any condition that is minor, correctable, or a breed related minor condition is not covered.  Conditions which could go away, or are considered to be a condition which a puppy will likely grow out of is not covered. The conditions not covered include but are not limited to:  umbilical hernia, any disease the puppy has been vaccinated against or is native to the environment, cuts, injuries, any internal parasite, skin disorders such as mange or allergies, or any other minor condition.  Minor conditions are too numerous to completely cover in this document.  Any minor condition may be discussed with the Seller for consideration.  Hip dysplasia is covered for two years from date of birth.  Types of hip dysplasia not covered are nutritional and environmental dysplasia.  Should the dog develop hip dysplasia before the age of twenty-four months with an OFA rated moderate or severe or a Penn Hip rating of 30% or lower and a signed verification of said condition by a registered veterinarian as well as an OFA or Penn Hip certification.  Seller will replace the dog as one becomes available.  Buyer has the option to retain ownership of the dog.  The Buyer must follow the Seller's nutritional and environmental guidelines exactly.  If there is a question regarding the guidelines, the Seller is open for communication

·       Vaccinations: The Vizsla Club of America has established a special protocol for vaccinating Vizsla puppies due to immuno-deficiency problems in this breed. It is required and your pup’s best interest to adhere to this protocol. Not following the protocol will void this contract. Depending on the age of this pup at time of purchase will determine whether the pup has received any vaccinations.

·       Seller does not assume responsibility for any other veterinary bills or other expenses incurred by the purchaser on behalf of the dog after the dog has left the kennel.

·       The Buyer agrees to maintain preventative healthcare of the puppy including, but not limited to: inoculations, internal as well as external parasites, heartworm preventative medication. In the event a Buyer exercises return rights under one-year heath guarantee, all documentation that the above maintenance has been performed must be provided to Seller. If the buyer does not provide such proof that every step was taken to assure the good health of the puppy, no refund or replacement puppy will be given.

·       The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercises or excessive running, until at least 12 months of age.)

·       If the puppy has been sold as a pet/companion dog; BGK does not sell brood bitches or stud dogs (unless otherwise arranged). They are sold with the AKC Limited Registration, which states this dog may be registered and can compete in AKC field, agility or obedience. But any offspring resulting from mating can not be AKC reg. Unless a title is obtained

·       If the puppy is being sold with limited registration, the buyer agrees to not have the puppy spayed/neutered until at least 24 months of age.  If the buyer spays/neuters before this time there will no health guarantee.

·       If the puppy is to be sold with full registration, BGK will co-own the pup until an AKC title is obtained (Conformation, Field, Obedience or Agility) then the pup will be transferred over to the buyer at that time.

·       The buyer agrees that this animal will not be used for breeding purposes until it is at least 25 months of age and the mating should also be approved by BGK.  All offspring will be sold on limited registration unless approved by BGK. If this is breeched BGK will pursue a $3000 fine on each pup sold without approval. The mate should be registered with AKC or other certified dog registry (FDSB, UKC, CKC) and preferably after it has passed the following and has proof there of:

ü  X-ray and evaluation of hips and elbows by certified veterinarian

ü  Currant negative Brucellosis report from vet

ü  Current CERF Certificate (eyes)

ü  All inoculations and worming up to date

  • Should the Buyer be unable to keep this dog for any reason, the Buyer agrees never to take this dog to a pound or public shelter. The buyer will return this dog to BGK and pay all expenses of returning the dog.

  • The buyer agrees that the seller may repossess the animal upon evidence of neglect/abuse or if this contact is breached in any way at no expense to the seller, no refund will be given to the buyer.

  • This agreement is made and signed by both parties to insure the well being and protection of these obligations here under.

  • Should the seller need to seek legal action against the buyer for violations of this agreement, the buyer will assume any and all attorney costs and court fees.

  • All deposits are non-refundable, but are transferable to another litter.
